AGU Requests Time for Analysis at the Supreme Court
The Advocacy-General of the Union formalized a request to the Federal Supreme Court to have 72 hours to present a joint statement from the Presidency of the Republic and the agency itself regarding the actions involving the betting sector. The request was filed on Monday (28) and is under analysis by Minister Luiz Fux.
Previous Requests from Entities
Still on Monday morning, the National Association of Games and Lotteries and the Brazilian Institute of Responsible Gaming had already requested Fux to suspend the effects of the provisional measure issued by President Luiz Inácio Lula da Silva. The entities claim that the rule immediately prohibits the exploitation, offer, and advertising of fixed-quota lotteries and online games.
Arguments from the Betting Sector
In the document sent to the rapporteur, the representative organizations of betting companies state that the provisional measure causes irreversible damages and that no urgency was demonstrated for its issuance. They also highlight the lack of planning for the shutdown of sites and applications, scheduled for October 6, and claim that the MP annuls law 14.790/2023 sanctioned by the federal government itself the previous year.
Procedural Nature of the Request
The AGU clarified that its request is strictly procedural and does not anticipate any position on the merits of the discussions. It is now up to Minister Luiz Fux to decide whether to grant the requested deadline before analyzing the requests presented by the sector associations.
