Ministers' Warning to the STF President
Supreme Federal Court ministers recommended that Edson Fachin avoid scheduling, before the first round, the judgment on false posts linking Flávio Bolsonaro to an alleged intention to remove Our Lady of Aparecida as patron saint of Brazil. The main concern is that live broadcast on TV Justiça would amplify political tensions less than a week before the vote.
Chain Decisions at TSE and STF
The case gained visibility after a rapid sequence of injunctions:
- André Mendonça, vice-president of the Superior Electoral Court, ordered the removal of the publications;
- Flávio Dino, from the STF, suspended that order, citing protection of freedom of expression;
- Luiz Fux reinstated the prohibition.
The exchange of decisions exposed divergences between the courts and revived discussions about the Banco Master case.
Risk of Exposing Internal Conflicts
During telephone conversations on Tuesday, 29, Fachin heard from colleagues that the plenary session could serve as a stage for public mentions of signs of proximity between magistrates and Daniel Vorcaro. Some ministers advocate postponement to prevent the internal dispute from gaining a new chapter on the eve of the election.
TSE Letter and Concern over Instability
Nunes Marques, president of the TSE, sent a letter to Fachin expressing “high concern” over the overlap of competencies. In the document, he warns that tight deadlines and contradictory decisions create legal uncertainty and encourage strategic litigation, weakening the predictability of electoral rules.
While a group of ministers calls for speed to end the controversy, Fachin has not yet included the topic on the agenda for this week's sessions.
