Minister Floriano de Azevedo Marques, of the Superior Electoral Court, announced on Tuesday (29) that he is stepping down as rapporteur of two electoral cases involving the ticket headed by Ciro Gomes.
Reason for the decision
The judge cited a “supervening fact” linked to a confidential proceeding at the Federal Supreme Court. Although the episode does not constitute formal impediment, Floriano chose to withdraw to avoid questions about his impartiality.
Under the Civil Procedure Code, the records return to the TSE Presidency for redistribution to another minister, who will decide whether to maintain or cancel the injunction granted the previous day.
What the injunction ordered
On Monday (28), Floriano had suspended campaign acts by Roberto Cláudio, candidate for lieutenant governor, and Captain Wagner, candidate for the Senate, both from União Brasil. The measure responded to requests from the state directories of União Brasil and the Progressistas.
Internal party dispute
The conflict arose after the União Progressista Federation approved support for Ciro Gomes’ coalition, contradicting state convention decisions that favored Elmano de Freitas (PT). The directories turned to the courts to suspend the effects of the federation convention held on July 26.
Candidates’ reaction
Hours before the declaration of suspicion, Roberto Cláudio and Captain Wagner stated in a press conference that they would maintain their candidacies and requested the minister’s removal. They claimed that the judge’s daughter, Laura de Azevedo Marques, acts as lawyer for Júnior Mano (PSB), alternate on Cid Gomes’ ticket.
The new rapporteur will define the campaign’s direction in the coming days.
