Judgment at TST defines the course of the strike
The Superior Labor Court decides this Tuesday (29) the collective dispute filed by Caixa against the strike movement that began on September 10. The legal action arises after the end of the collective agreement on August 31, without the parties reaching an understanding.
Central point of the conflict
Negotiations stalled mainly over the reformulation of the Saúde Caixa funding model. The public company defends unilateral changes, while workers reject any alteration without consensus.
- Thirteen rounds of talks have already been held
- Mediation by the Public Ministry of Labor also took place
- Assemblies were held across the country
Position of the employees
In a petition filed on Saturday (26), the representative entities (Contraf and Contec) state that the strike is legitimate, that exclusive responsibility cannot be attributed to the employees for the impasse, and that issues such as Saúde Caixa cannot be decided in isolation by the bank.
Injunction already in force
On the 25th, Minister Mauricio Godinho Delgado ordered that at least 60% of employees remain active, in person or remotely, under a daily fine of R$ 100 thousand in case of non-compliance. Caixa had requested 80% of the workforce; the magistrate also denied the request to prohibit acts that prevented access to branches, noting that the law already requires a peaceful strike.
Tomorrow's judgment should clarify whether the movement will be considered abusive and which rules will apply while the strike lasts.
